Marcatura CE di macchine completate solo presso l’utilizzatore

Una macchina — o un insieme di macchine — che non può essere completata presso la sede del fabbricante, ma che necessita di attività di installazione presso l’utilizzatore, dovrà essere dichiarata conforme alla direttiva macchine solamente quando l’installazione è completata.

Quindi la dichiarazione CE di conformità della macchina potrà essere emessa solamente una volta terminata questa fase — quando tutte le misure di sicurezza previste saranno presenti e funzionanti — momento a partire dal quale la macchina potrà essere messa a disposizione dell’utilizzatore.

A questo proposito la guida all’applicazione della direttiva macchine 2006/42/CE emessa dalla Commissione Europea[1] indica:

  • 73 […] The manufacturer may need to operate or test the machinery or parts of it during construction, assembly, installation or adjustment before it is placed on the market or put into service. In that case, he must take the necessary precautions to protect the health and safety of operators and other exposed persons when carrying out such operations, in accordance with the national regulations on health and safety at work and on the use of work equipment implementing the provisions of Directives 89/391/EEC and 2009/104/EC […]. However, the machinery concerned is not required to comply with the provisions of the Machinery Directive until it is placed on the market or put into service.

  • 86 […] Machinery that is placed on the market in the EU is put into service when it is used in the EU for the first time. This applies to new machines that are completed and tested at the users site (may be referred to as ‘in-situ’ manufacturing), including both machines the user has built himself or have been built for him by another. […] The machinery may need to be tested as part of the installation and commissioning process for a short and limited period under the full control of the manufacturer, which includes the control of the persons involved in the testing. This process may then result in further modifications being required prior to CE marking and the issuing of the Declaration of Conformity. Only then it can be “cleared” for use or production and handed over to the user. This testing process must not be used for production as a way of getting around the legislation. This testing is considered to be part of the manufacturing process and not being put into service. However, during this period, full compliance must be fulfilled with the requirements of the national legislation that implements Directive 2009/104/EC concerning the minimum health and safety requirements for the use of work equipment by workers at work.

Durante la fase di montaggio ed installazione della macchina, quindi  prima che questa venga marcata con il simobolo CE, dovranno essere adottate  tutte le misure necessarie per garantire la sicurezza delle persone coinvolte nel processo di montaggio ed installazione o delle altre persone presenti in loco.

Queste misure possono comprendere, ad esempio:

  • l’utilizzo di misure di protezione alternative, quali perimetrazione dell’area in cui si stanno svolgendo i lavori di montaggio ed installazione;
  • la regolamentazione degli accessi a tale area, restringendoli alle sole persone sufficientemente formate sui rischi presenti e sulle modalità per minimizzarli;
  • l’uso di adeguati dispositivi di protezione individuale, per quanto necessari;
  • l’impedimento del funzionamento non sorvegliato della macchina, per esempio bloccando i sezionatori delle alimentazioni in posizione di circuito isolato quando non sono presenti le persone deputate a controllare che la macchina possa funzionare solamente in assenza di persone esposte;
  • la definizione di procedure comportamentali per tutte le persone che possono essere presenti in loco.

Durante la fase di montaggio ed installazione della macchina possono, se del caso, essere adottate misure di sicurezza specifiche per tale fase, ad esempio dispositivi di sicurezza che agiscono solamente su parte della macchina.

I rischi residui, dovuti all’incompleta protezione garantita da queste misure, dovranno essere gestiti in accordo alla legislazione locale in materia di sicurezza e salute nei luoghi di lavoro.

Prima che la macchina venga marcata CE, e dunque possa essere usata dall’utilizzatore, tutte le misure di sicurezza previste dovranno essere installate ed operative.

A questo proposito, è opportuno che al termine del montaggio ed installazione della macchina venga eseguito un controllo delle misure di sicurezza della macchina (comandi di arresto di emergenza, posizionamento ripari, monitoraggio di parametri di funzionamento critici, ecc.), in modo da attestare che la macchina è completamente conforme ai requisiti della direttiva 2006/42/CE.

Tale collaudo dovrebbe essere documentato mediante un apposito verbale e sarebbe meglio che fosse eseguito congiuntamente con rappresentanti dell’utilizzatore.
